Terms of Service

Welcome to Sticksy! These Terms of Service (“Terms”) govern your use of Sticksy’s website and services. By accessing or using Sticksy, you acknowledge that you accept and agree to be bound by these Terms and our Privacy/Cookie Policy. If you do not agree to these Terms, please do not use the Site or our services. Any use of the Site by you constitutes your acceptance of these Terms.
A. Definitions
Summary: These terms are used throughout this Terms of Service and it’s important that you understand what we are referring to when we use them.
Terms not defined in this section shall have the meaning provided elsewhere in the Terms of Service.
- Sticksy (also “we”, “us”, “our”) refers to Sticksy, Inc., the company operating this website and selling the products.
- Site/Service: Our online store at sticksy.ca (and any associated websites or apps) through which we offer custom-printed physical products.
- Products: The physical stickers, posters, cards, and custom prints offered for sale on the Site. All Products are printed and shipped in physical form; no digital goods or downloads are provided.
- Order: Your request to purchase one or more Products via the Site. An Order is made by completing the checkout process and paying the required fees.
- You/Customer: Anyone who accesses the Site or places an Order. You must be the age of majority in your province (typically 18 or 19) or have parental consent to use the Service.
- Account: Your user account on the Site (if you choose to create one). You may also check out as a guest without an Account.
- User Content: Any design files, artwork, images, text, or other materials you submit to Sticksy for use on Products (for example, a custom image you upload to be printed).
B. General
By accessing or using the Sticksy Site or placing an Order, you agree to be bound by these Terms of Service and all policies incorporated herein (including our Privacy Policy, Cookies Policy, Shipping Policy, Returns Policy, etc.). If you do not agree to these Terms, you must not use the Site or purchase Products. Sticksy reserves the right to refuse service or cancel any account or Order for any reason at any time. You must use the Site lawfully: you may not use the Service for any illegal or unauthorized purpose (including infringement of intellectual property or copyright laws). Transmitting viruses or other harmful code is prohibited. We may suspend or terminate your access if you violate these Terms.
Your use of the Site is at your own risk. We do not guarantee uninterrupted or error-free access, and Products are provided “as is” without any warranties, express or implied. Sticksy does not guarantee the accuracy, completeness, or timeliness of any Site information. All information on the Site is subject to change or removal without notice.
Our Site may contain links to third-party websites or services. We do not control or endorse third-party content and will not be responsible for any loss or damage caused by your use of such linked sites. You should review the terms and privacy policies of any third-party sites you visit.
C. When Do These Terms Apply?
These Terms apply as soon as you access our Site or use any Sticksy services, including browsing products, creating an Account, or placing an Order. By using the Site in any way – for example, designing a product or completing checkout – you automatically accept these Terms. The current effective date of these Terms is posted at the top of this page; sticksy.ca will display the date of the latest revision, and you should review the Terms each time you visit.
D. Can These Terms Be Modified?
Yes. Sticksy reserves the right to update or modify these Terms at any time. We will post any changes on our Site. It is your responsibility to check the Site periodically for updates. Your continued use of the Site or any Sticksy services after changes are posted means you accept the new Terms. We will clearly note the effective date of any revision.
E. Scope of Sticksy’s Services
Sticksy is an online retailer of custom-printed physical products. We offer personalized stickers, posters, business cards, greeting cards, and other print products. You can choose from a wide range of materials, finishes, and shapes to match your vision; all products are crafted with durable, high-quality materials. You submit your artwork or designs (or use our online design tools), and we print the Products and ship them to you. All orders are printed and shipped from Canada, and we currently ship only to Canadian addresses. Both individuals and businesses (B2B customers) may order through the Site. Whether you shop as an individual or on behalf of a company, you must comply with these Terms.
F. User Content and Prohibited Activities
User Content Responsibility
If you submit any artwork, text, images, or other material to Sticksy (for example, uploading a design to be printed), you are solely responsible for that content. You represent and warrant that you have all rights and permissions necessary to use the content, and that it does not infringe any third party’s intellectual property or other rights. In other words, do not upload or provide any material that violates copyright, trademark, privacy, publicity, or other rights of others. You also warrant that your content is not defamatory, threatening, obscene, or unlawful.
By submitting your content to Sticksy, Sticksy does not claim ownership of it, but you grant Sticksy (and our affiliates and service providers) a royalty-free, perpetual, irrevocable, transferable, worldwide license to use your content to produce and sell the Products. For example, this license allows us to print your design on the Products you order and to store or modify the design as needed for production. You retain ownership of all copyright and intellectual property in your content.
Prohibited Activities and Content
You agree not to misuse the Site or Sticksy’s services. For example, you may not:
- Upload or submit any content that is illegal, obscene, pornographic (except as permitted for adults in artistic contexts), hateful, harassing, violent, discriminatory, or defamatory. Designs promoting extremist, violent, or hate group ideology are forbidden. Content depicting explicit sexual activity, child exploitation, or bestiality is also prohibited. Designs that encourage illegal drug or alcohol abuse, underage drinking, or self-harm will not be fulfilled.
- Violate any laws or regulations, including export controls or sanctions.
- Upload viruses, malware, or any other malicious code.
- Spam, harvest data, reverse-engineer the Site, or otherwise interfere with the Site’s operation.
- Submit content that infringes copyrights, trademarks, or other proprietary rights of third parties.
Sticksy reserves the right to refuse, cancel, or remove any content or Order that we reasonably believe violates these rules. If we discover that your submitted content is prohibited, we may cancel your Order and refund you, and you will not hold Sticksy liable for doing so.
G. Orders and Payment
Placing an Order means you request that Sticksy produce and ship the specified Products. You must provide all required information (design files, quantity, shipping address, etc.) and pay all fees in full at the time of checkout. Sticksy accepts major credit cards (e.g. Visa, MasterCard, American Express), as well as other payment methods offered at checkout (such as PayPal or Apple Pay). All prices and payments are in Canadian dollars, and applicable sales taxes (GST/HST) will be added to your order where required by law.
By submitting payment details, you represent that you are authorized to use the selected payment method and authorize us to charge that method for the full order amount. If payment is declined or fraudulent, we may cancel your Order. If an error is found (for example, a typo in price or product description), we also reserve the right to cancel the Order and refund you.
Order Confirmation
Once payment is successful, you will receive an email confirmation. Please review your Order carefully: Sticksy is not responsible for errors you make in entering order information. If you notice a mistake, contact us immediately; we will accommodate changes if the Order has not yet entered production.
Cancellation/Modification by Sticksy
Sticksy may limit or cancel any order at our discretion. For example, we reserve the right to refuse or cancel any order you place. We may limit quantities, combine shipments, or decline orders from those we suspect of fraud, reselling, or violating our policies. If we change or cancel an Order, we will attempt to notify you via the contact email or phone you provided, and we will refund any charges for cancelled items. Sticksy shall not be liable for any losses or penalties suffered due to a cancelled order.
H. Shipping and Delivery
Sticksy ships all products via recognized carriers (e.g. Canada Post, UPS, FedEx, etc.) to addresses within Canada only. You are responsible for providing a valid Canadian delivery address. Shipping charges and estimated delivery times (varying by carrier and location) will be shown at checkout. All delivery dates are estimates; Sticksy will make reasonable efforts to ship orders promptly but is not liable for shipping delays. I. Returns, Refunds and Replacements
Due to the custom nature of Sticksy’s Products, returns and refunds are handled under our dedicated Returns & Replacements Policy. In general, Sticksy does not accept returns or offer refunds for custom-printed items unless the product is defective or not as ordered. If you have an issue (wrong item, missing item, or product defect), please follow the instructions on our Returns & Replacements page to request a remedy. Replacement or refund decisions are made in accordance with Canadian consumer protection law.
J. Account Benefits, Privacy and Cookies
You may checkout as a guest or create a Sticksy account. Creating an account (available to anyone, personal or business) allows you to save shipping addresses, view order history, and receive promotional emails. You are responsible for keeping your account information (username, password, billing address, etc.) secure and up-to-date. In particular, you agree that all personal information you provide is truthful and accurate, and you must update it if it changes. Sticksy may suspend or terminate your account if you violate these Terms or use the account for unauthorized purposes.
Our Privacy Policy (and Cookies Policy) govern how we collect and use your personal information and how we use tracking technologies. By using the Site or creating an account, you agree to Sticksy’s data practices as described in those policies. K. Order-Related Issues and Support
If you have any questions or problems with your Order (such as missing items, defective products, or other issues), contact Sticksy customer support as soon as possible. Include your Order number, a description of the issue, and any relevant photos. We will address reasonable order issues in accordance with our policies. Sticksy is not responsible for loss or delays caused by events beyond our control (carrier delays, customs, postal strikes, etc.).
L. When Your Order May Be Cancelled
Sticksy reserves the right to cancel any Order at any time, in whole or in part, for any of the following reasons (this list is not exhaustive):
- The Product ordered becomes unavailable (sold out or discontinued).
- There is a mistake in the pricing, product description, or other information on the Site.
- Your payment fails or is suspected of fraud.
- The shipping address is invalid or undeliverable.
- You have violated these Terms (e.g. by submitting prohibited content).
If we cancel your Order, we will notify you (by email) and issue a refund for any amounts paid for the cancelled items. Sticksy is not liable for any third-party costs or losses due to such cancellation. (For example, we may limit or prohibit orders from those we believe are dealers or resellers)
M. Limitation of Liability
THE SERVICE AND PRODUCTS ARE PROVIDED “AS IS”, without warranties of any kind. TO THE FULLEST EXTENT PERMITTED BY LAW, Sticksy and its directors, officers, employees, affiliates, suppliers, and agents will not be liable for any direct, indirect, incidental, special, consequential or punitive damages of any kind arising from your use of the Site or Products, including but not limited to lost profits, lost data, loss of goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. This includes any losses arising from errors in content (e.g. design proofs), delays, damage to the Products during shipping, or your inability to use the Site.
In other words, Sticksy does not guarantee that products will meet your specific needs, and you use the Service at your own risk. Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for consequential damages; in such cases, Sticksy’s liability will be limited to the maximum extent permitted by law.
N. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Any dispute arising under these Terms or in connection with your use of Sticksy’s services shall be resolved exclusively in the courts located in Nova Scotia, Canada, and you and Sticksy each submit to the jurisdiction of those courts. If you live in a province that requires otherwise by law, Canadian consumer protection laws will apply.
